Terms & Conditions
Last updated: 5 October 2026
1. About us and these terms
These terms and conditions ("Terms") apply to all services provided by Next Wave Logistics ("we", "us", "our") to you ("you", "the Customer"). By creating an account, making a booking or sending goods to our depot, you agree to these Terms.
We act as a freight forwarder arranging the carriage of goods from our UK depot in Portsmouth to Jersey, Channel Islands. We may use third-party carriers, hauliers, ferry operators and depots (including Ferryspeed and ProFreight) to perform the services.
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 (United Kingdom) or the Supply of Goods and Services (Jersey) Law 2009 and other applicable Jersey consumer protection law.
2. Definitions
"Goods" means the items you ask us to transport, including any packaging. "Booking" means an order for services placed through our website. "Shipping ID" means the unique reference issued to your account. "Depot" means our receiving address at ProFreight, Ackworth Rd, Hilsea, Portsmouth, PO3 5JT.
3. Your account and bookings
You must be at least 18 years old and provide accurate, complete information. You are responsible for keeping your login details secure and for all bookings made from your account.
A contract is formed when we confirm your booking and payment has been received. We may refuse or cancel any booking at our discretion, in which case we will refund any amount paid for services not performed.
You must quote your Shipping ID on the second line of the delivery address when ordering goods to our Depot. We are not responsible for delays or loss arising from goods that arrive without a correct Shipping ID or matching booking.
4. Prices and payment
Prices are shown in pounds sterling (GBP) and are based on the package size you select. Payment is due in full at the time of booking.
If goods received at the Depot are larger or heavier than the size booked, we may charge the difference or hold the goods until the correct charge is paid. We will contact you before charging any additional amount.
Our prices do not include Jersey import GST, customs duties or charges levied by authorities. These are your responsibility and must be paid directly to Jersey Customs and Immigration Service (JCIS) or as otherwise instructed.
Queries about invoices or payments should be sent to accounts@nextwavelogistics.co.uk.
5. Your responsibilities for the goods
You warrant that you own the Goods or are authorised by the owner to make the booking, and that the description, value, weight and dimensions you provide are true and complete.
Goods must be suitably packed by the retailer or sender to withstand normal handling and carriage. We are not liable for damage caused by inadequate packaging.
You must not send any item listed on our Prohibited & Dangerous Goods page. Dangerous goods may only be sent with our prior written approval. You will be liable for all costs, fines and losses arising from prohibited, dangerous or misdeclared goods, and we may hold, return, dispose of or surrender such goods to the authorities.
6. Customs and import declarations
Goods entering Jersey are subject to import controls under the Customs and Excise (Jersey) Law 1999 and the Goods and Services Tax (Jersey) Law 2007. You authorise us and our agents to use the information you provide to prepare or support any customs declaration.
Making a false or misleading declaration is a criminal offence. You must keep original retailer documentation (receipts, invoices or order confirmations) and make it available to JCIS, HMRC, us or our agents on request.
Once goods arrive in Jersey we will send you a customs reference so you can declare and pay any GST due. Business customers may provide their GST registration (B) number. Goods may be held until all customs requirements are met, and we are not liable for delays caused by customs checks.
You must declare the Goods and pay any GST or duties due within 3 business working days of the customs reference being issued. Goods not declared within this period will be charged storage at £10 per day until the declaration is completed and the Goods can be released, unless pre arranged.
7. Collection, carriage and delivery
Delivery times given are estimates only and depend on sailings, weather, third-party carriers and customs clearance. Time is not of the essence and we are not liable for delays outside our reasonable control.
We will deliver to the Jersey address in your booking. If delivery cannot be completed after reasonable attempts, we may store the goods and charge reasonable storage and redelivery fees.
Goods not collected or accepted within 30 days of arrival, or for which charges remain unpaid, may be sold or disposed of after we have given you written notice, with the proceeds applied to sums owed to us. If goods are still detained after 90 days, they will be passed over to Customs to collect and dispose of.
We have a general lien over goods in our possession for any unpaid amounts you owe us.
8. Inspection
We, our carriers and the relevant authorities may open and inspect any Goods at any time for safety, security or customs purposes, without liability to you.
9. Liability and claims
We will provide our services with reasonable care and skill. Subject to the paragraphs below, our liability for loss of or damage to Goods is limited to the lower of the declared value of the Goods or £100 per booking, unless additional cover has been agreed in writing before shipment.
We are not liable for: indirect or consequential loss, loss of profit or business; damage caused by inadequate packaging, inherent defects or the nature of the Goods; prohibited or misdeclared Goods; or events beyond our reasonable control, including weather, sailing cancellations, strikes, accidents or government action.
Visible damage or shortage must be noted on delivery and reported to info@nextwavelogistics.co.uk within 3 days of delivery, with photographs. Claims for non-delivery must be made within 14 days of the expected delivery date. Packaging must be kept for inspection.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
Where our services are provided to business customers, our total liability is limited to the price paid for the relevant booking, save as stated above.
10. Cancellations and refunds
Consumers may have a right to cancel a services contract made online within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By asking us to start the service within that period, you agree that once the service has been fully performed you lose the right to cancel, and if it has partly been performed we may deduct a proportionate amount.
You may cancel a booking free of charge before your Goods have been received at our Depot by emailing info@nextwavelogistics.co.uk. Once Goods have been received or are in transit, the booking cannot be cancelled.
Refunds will be made to the original payment method within 14 days of a cancellation being accepted.
11. Personal data
We process your personal data in line with the UK General Data Protection Regulation, the Data Protection Act 2018 and the Data Protection (Jersey) Law 2018. We use your information to provide our services, communicate with you, meet customs requirements and comply with the law, and we share it only with carriers, agents and authorities as needed to perform the service.
12. Complaints
If you are unhappy with our service, please contact info@nextwavelogistics.co.uk. We aim to acknowledge complaints within 3 working days and respond fully within 14 days. Jersey consumers may also seek advice from the Jersey Consumer Council or Trading Standards; UK consumers may contact Citizens Advice.
13. General
We may update these Terms from time to time. The version in force when you make a booking applies to that booking.
If any part of these Terms is found to be unenforceable, the rest will remain in effect. No failure or delay in enforcing these Terms is a waiver of our rights.
You may not transfer your rights under these Terms without our consent. A person who is not a party to these Terms has no right to enforce them.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Where you are a consumer resident in Jersey, you also benefit from any mandatory protections of Jersey law, and you may bring proceedings in the courts of Jersey or of England and Wales. Business customers agree to the exclusive jurisdiction of the courts of England and Wales.
